The claimant cannot access the name of the natural persons holding a tourist dwelling activity license associated with the registration number in the Tourism Register of Catalonia, but could be presented with anonymized information with a territorial aggregation level guaranteeing the non-identification of the persons concerned.

It is decided to fine the company that has been complained of, which is responsible for providing the public service of the tourist office in Alella, by means of a fine fine of  1.5001,500, since an e-mail was sent from that same office, without using hidden copying, to people who had booked a visit to a winery. This fact meant that the recipients of the message could see the email address of the other recipients and that they knew that the recipients had also reserved a visit to the cellar, in contravention of the principle of confidentiality of data.

Leaving aside the communications of data destined to countries of the EU, the transfers aimed for by the entity will only be able to be made if suitable guarantees about the protection that the data will receive are brought in its destination in the terms established in the article 46 of the RGPD, since it has not been stated that the countries that will be addressing offer a suitable level of protection and since a priori none of the exceptional suppositions of the article 49.1 of the RGPD would result from application. This, without harm of the fulfillment of the rest of principles and duties established on the subject of data protection.

The data processing of inspected persons does not harm the principle of consent/sanctioned by the commission of presumed administrative offenses, when organs make the treatment in exercise of the functions of inspection and sanction. When the data do not retire directly of the person concerned is not demanded to give fulfillment to the law of information if the recording and/or the communication of the data (to the responsible for the treatment) are foreseen to a rule with rank of law.
