Initially was attributed, with regard to the circumstantial test, that the Town Council would have facilitated -or allowed- to the political party the access to the mentioned data, so that the duty of secret would have been harmed, which is typified as a severe offense. Finally but it was considered that there was not test sufficient to maintain the imputation, and was stayed, with the transfer to the AEPD in that referring to the treatment of the data carried out by the political party.
